HABEAS CORPUS

Sometimes the last opportunity for justice for a convicted person is through a petition for a writ of habeas corpus.  The Great Writ is available to individuals who have been convicted in either state or federal court.

However, under the Clinton Administration, Congress imposed a one-year statute of limitations for the first time on this fundamental remedy.  This means that, with only a few exceptions, a person convicted in either state or federal court must start his or her habeas corpus litigation within a year after the conviction becomes final.
